Article 14 explained in plain English
After Article 13 listed what the administrative courts have jurisdiction over, this article sets out what falls outside the jurisdiction of the Board of Grievances courts. These courts may not hear:
- Cases relating to acts of sovereignty. The article does not define acts of sovereignty or give examples.
- Objections to judgments of other courts: That is, judgments issued by courts not subject to the Board of Grievances Law, where those judgments fall within those courts' jurisdiction. The Board is not a body of objection to the judgments of other courts in matters within their jurisdiction.
- Decisions of the councils: Decisions issued by the Supreme Judicial Council, the Administrative Judiciary Council and the Council of the Public Prosecution.
This article was amended by Royal Decree No. M/126 dated 14/9/1441 AH by adding the phrase "the Council of the Public Prosecution", so decisions of that council became decisions the Board's courts do not hear.
The importance of this article is practical: anyone who wants to bring a case before the administrative courts must make sure its subject does not fall within these exceptions. If a case on a single subject is brought before the Board's courts and another body, Article 15 governs how the competent body is determined. To assess whether a particular dispute falls within these exceptions, it is advisable to consult a lawyer specialized in administrative cases.
Practical example
A general court issued a judgment in a dispute within its jurisdiction between Ahmed and another person, and Ahmed wanted to challenge it before the administrative court. This article makes clear that the Board of Grievances courts do not hear objections to judgments of courts not subject to its law where they fall within those courts' jurisdiction.
