Article 97 explained in plain English
This article of the Regulations specifies who issues four groups of rules that supplement the Bankruptcy Law and its Regulations:
- Rules on cross-border bankruptcy procedures: issued by the Minister in coordination with the Minister of Justice.
- Rules for running meetings: issued by the Minister. Under Article 1 of the Regulations, these are rules for running meetings relating to bankruptcy procedures.
- Rules on procedures in bankruptcy cases: issued by the Minister of Justice in agreement with the Supreme Judicial Council, and they must include the procedures for considering applications, issuing judgments and decisions, objecting to them, and their enforceability.
- Rules on fees of trustees and experts: issued by the Minister of Justice in coordination with the Bankruptcy Committee.
Note that the wording of the other body's participation differs between items: "in coordination" in items one and four, and "in agreement" in item three, while the Minister alone issues item two.
In practice, this means that someone looking for the details of these matters, such as the deadlines for objecting to bankruptcy judgments, the amount of a trustee's fees or how a creditors' meeting is run, will not find them in this article but in the rules issued by the bodies named.
The article follows Article 96, which allows the private sector to be used for support services, and precedes Article 98, which provides for publishing the Regulations and the rules issued under them in the Official Gazette, with effect from the date each is published.
