Article 5 explained in plain English
This is one of the Law's most important articles. It sets the media content controls that everyone who carries out an activity or profession in the field, individuals and bodies alike, must comply with. The phrase "in particular" means the list is not exhaustive.
The controls can be grouped into themes:
- Fundamentals and policy: complying with the Kingdom's media policy; not attacking or insulting the Divine Essence, the angels, the Holy Quran, the prophets, the wives of the Prophet (peace be upon him) or his companions, or anything that touches the fundamentals of Islamic Sharia; and not harming the King or the Crown Prince.
- Peace and security: not stirring up strife and hatred among citizens or inciting violence; not inciting terrorism; not harming the Kingdom's relations with Arab, Islamic or friendly states; and not disturbing public order and national security.
- Individuals' rights: protecting intellectual property; respecting human dignity; not broadcasting false information that is not based on documented facts; not infringing the sanctity of private life; and respecting freedom of expression in a way that does not conflict with the laws.
- Public morals: not showing content that offends public morals, nudity, immodest dress, content that arouses desires, or vulgar language; and requiring female presenters on television channels licensed to work in the Kingdom to wear covering dress and a modest appearance, with specifications set by the regulations.
- Advertising and promotion: not broadcasting advertisements for medicines, dietary supplements or investment products not licensed by the competent authorities; not promoting or approving of drugs, psychotropic substances, alcohol or tobacco; and keeping a balance between advertising time and media content.
The seventeenth control lets the Board adopt any other control. Violating these controls exposes the violator to the penalties in Article 17. A person facing accountability over content they presented needs to consult a lawyer who specializes in media regulation and administrative matters.
Practical example
An advertiser asked a licensed radio channel in Jeddah to broadcast an advertisement for a dietary supplement that is not licensed by the competent authority. Broadcasting this advertisement violates the ninth control, so the channel should refuse it or first verify that the product is licensed.
