Article 6 explained in plain English
This article sets out the licensee's duties, noting that they apply according to the type of license, so not every duty applies to every licensee. The duties are:
- Complying with the license conditions and the type of media content specified for the licensee.
- Complying with the frequencies allocated for broadcasting and reception and with the geographic coverage area specified, in accordance with the technical procedures and standards.
- Keeping a complete record of all material broadcast during the last 90 days, and providing the Authority with what it requests of that material for review within the period specified in its request.
- Providing the facilities the competent authorities need to carry out their duties.
- Paying the license fee when it falls due.
- Complying with the approved technical specifications for broadcasting, rebroadcasting and receiving equipment.
- Providing any statement or information the Authority requests relating to broadcasting, rebroadcasting, production or distribution.
- Complying with what the Authority adopts in emergencies and disasters.
- Giving priority to Saudi human and material resources where available, in accordance with the laws and what the Authority adopts.
- Participating in developing national industries related to national audiovisual media production, as the regulations set.
- Complying with the decisions the Authority issues.
Among these duties, the most important in practice is keeping the record of what was broadcast: the licensee needs an archiving system that preserves everything it broadcast in the last 90 days. The fee duty ties in with Article 10, which tasks the Board with setting rules for determining it. Breach of these duties is a violation of the Law that may bring the penalties in Article 17. A licensee who needs to review its compliance may consult a lawyer who specializes in media regulation and administrative matters.
Practical example
The Authority asked a licensed radio station in Dammam for the recording of a program broadcast 50 days earlier so that it could review it, and set a deadline for delivery. Because the article requires the station to keep a complete record of what it broadcast in the last 90 days, it must deliver the recording within the set deadline.
