Article 17 explained in plain English
This article of the Regulations designates the Supreme Court as the judicial body in two matters connected with two provisions of the Arbitration Law.
Paragraph (1): an appeal against a judgment annulling an arbitral award, provided for in paragraph (2) of Article 51 of the Law, lies before the Supreme Court. This article does not state the content of that paragraph, or the rule on appealing anything other than a judgment of annulment.
Paragraph (2): the competent body referred to in paragraph (3) of Article 55 of the Law is the Supreme Court. This article does not state the subject of that paragraph, so the text of Article 55 of the Arbitration Law must be consulted to know the matter in which the Supreme Court is competent under it.
"The Law" here means the Arbitration Law, according to Article 1 of the Regulations. This designation differs from the general rule in Article 2 of the Regulations, which makes the competent court referred to in the Law and the Regulations the court of appeal originally competent to hear the dispute, except cases excluded by the Law.
This article does not state the period for appeal or its procedures. It is linked to Article 18 of the Regulations, under which an annulment action is not accepted from someone who waived their right to it after the award was issued, and which specifies the documents the claimant of annulment attaches to the action.
Anyone against whom a judgment annulling an arbitral award has been issued and who wants to appeal should consult a lawyer who specializes in arbitration and commercial cases.
Practical example
A company in Riyadh filed an action to annul an arbitral award issued against it, and the court ruled to annul it. If the other party wants to appeal this judgment of annulment, its appeal lies before the Supreme Court.
