Article 26 explained in plain English
This article identifies who imposes the penalties in Article 25, and how they are objected to. Excepted is what Article 31 provides, which makes the competent court the body that hears violations of Article 28.
1- The Ministry's fines: The Ministry imposes a fine of no more than SAR 100,000, according to the classification tables referred to in paragraph 2 of Article 25. It may impose a fine for each day the violator continues after being notified of the decision, starting from the date the decision specifies.
2- The committee: One or more committees of at least 3 members, including a specialist in Sharia or law, handle:
- Hearing and deciding violations of the Law, the Implementing Regulations and the license.
- Approving the penalties in Article 25.
- Hearing the objections of those concerned to fines the Ministry imposes.
3- Its formation: By decision of the Minister for 3 years, renewable, chaired by a specialist in Sharia or law, and its decisions are by majority and reasoned. The Minister approves its decisions imposing a fine exceeding SAR 1,000,000 or cancelling the license, or both.
4- Grievance: A grievance may be filed against the committee's decision before the Administrative Court in accordance with its law.
5- The Implementing Regulations set the committee's working rules and its members' remuneration.
The practical path is therefore: a smaller fine from the Ministry, objected to before the committee, then a grievance against the committee's decision before the Administrative Court.
If you have a specific situation, it is best to consult a lawyer specializing in administrative matters and agricultural laws.
Practical example
The Ministry imposed a fine of SAR 40,000 on a nursery in Dammam for violating its license conditions. The nursery owner may object to the fine before the committee, and if the committee upholds it, he may file a grievance against the committee's decision before the Administrative Court in accordance with its law.
