Article 25 explained in plain English
This article sets out the general administrative penalties in the Agriculture Law.
Scope: They apply to anyone who violates any provision of the Law or the Implementing Regulations, without prejudice to Article 28 and to any more severe penalty provided by another law. Article 28 provides a penalty of imprisonment of up to 5 years and a fine of up to SAR 10 million, or either, for specific acts, such as manufacturing or importing banned or adulterated pesticides, harming animal resources, bringing in banned resources without approval, and obstructing inspectors.
The penalties, one or more of which may be imposed:
- A fine of no more than SAR 15,000,000.
- Suspension of the license, partially or fully, for a period not exceeding one year.
- Cancellation of the license.
- Closure of the facility for a period not exceeding one month.
Classification tables: The Minister issues, by his decision, tables that classify violations and set the penalties within the stated maximum, taking into account the nature and gravity of each violation and the aggravating and mitigating circumstances.
In practical terms, the SAR 15 million figure is a maximum, not a fixed amount; the actual fine for each violation is set by the Minister's tables according to its gravity and circumstances. To know the likely penalty for a particular violation, refer to those tables.
The body that imposes these penalties is regulated by Article 26.
