Article 5 explained in plain English
This article governs the duties of white land owners and those in a similar position, and sets who bears payment of fees and fines. The text shown is the version in force after its amendment by Royal Decree No. M/244 dated 7/11/1446 AH. The article has five paragraphs:
- Owners at the time of announcement: Owners of land announced as subject to the fee referred to in paragraph (1) of Article 3, and those in a similar position, must submit to the Ministry the documents and data relating to their land as the regulations determine, including the period and the controls of the announcement.
- New owners: Whoever acquires ownership of land subject to the fee after the announcement period has ended must submit the documents and data within the period the regulations set.
- Notification: The owner or one in a similar position is notified of the fee due from him according to the notification mechanisms set in the regulations.
- Vacant property: The regulations set the provisions in this article in a way consistent with the nature and uses of vacant property, taking into account the provisions of the Law relating to it.
- Responsibility for payment: In all cases the owner of the property is the first person responsible for paying the fees or fines in the Law, unless one in the owner's position pays them.
The article sets no periods in days; it refers the periods and notification mechanisms to the regulations. Article 4 also sets what the regulations govern as to the conditions for applying the fee, while Article 6 penalizes anyone who violates the provisions of the Law and regulations with a fine not exceeding the amount of the fee due. Anyone who has bought land that may be subject to the fee is best advised to consult a lawyer specialized in real estate cases.
Practical example
Abdullah bought a residential plot in Jeddah after the announcement period had ended on the lands in his area being subject to the fee. Under paragraph (2) of this article, he must submit to the Ministry the documents and data relating to the land within the period the regulations set, and he is then notified of the fee due according to the notification mechanisms set in them.
