Article 10 explained in plain English
This Article sets three procedural obligations that fall on different parties:
- The subscriber's registration: the subscriber must register with the Ministry within 90 days of the date of leaving work covered by the Law. Article 9 ties the start of entitlement to registration having been made within this period.
- The beneficiary's notice to the Ministry: the beneficiary must notify the Ministry within a period not exceeding 7 days from the date of either of the following:
- Any condition of entitlement to compensation ceasing to apply to them, for example getting a job.
- Any change in the data and information provided to the Ministry.
- The employer's obligation: the employer must provide the Ministry with the information it requests about the subscriber's work and the reasons the employment relationship ended.
The employer's obligation matters because the reason the relationship ended decides two important conditions of entitlement: that the subscriber was not dismissed for a reason attributable to them, and that they did not leave work of their own free will.
A beneficiary who is late in giving notice that a condition has ceased may receive amounts they are not entitled to, and elsewhere the Law penalizes anyone who provides incorrect data in order to benefit from compensation. Article 11 then sets the amount of compensation that is paid after that. Anyone who needs an opinion on a particular case should consult a lawyer specialized in social insurance.
Practical example
Hind registered with the Ministry a month after her contract with a company in Madinah was ended, and started receiving compensation. She then got a new job, so she must notify the Ministry within 7 days of that date, because the condition of having no income from work no longer applies to her.
