Article 13 explained in plain English
This article deals with attempts to evade imposed measures, in two paragraphs:
Paragraph 1 - what the Authority does when circumvention is established: it applies one or more of the following steps:
- Widening the scope: so that the measures cover another product that is a modified version of the product subject to the measure, or its parts, from countries that are or are not subject to it, or a like product from other countries, whether modified or not.
- Raising a specific exporter's measure: to the level of the general measure on its country or another appropriate level.
- Raising the level to counter absorption of the measure to an appropriate level.
In the last two cases this is without prejudice to paragraph (1) of Article 8, meaning that the measures may not exceed the finally determined dumping margin or amount of the subsidy.
Paragraph 2 - when circumvention is established: if one of the circumvention practices set out in Article 14 is proven (such as limited modification of the product, shipping through non-subject countries, manipulating documents, or simple assembly), and it is shown that the imports are still dumped or subsidized, and that there is injury or serious injury or that the remedial effect of the measures has been undermined, then circumvention is considered established when any of the following is present:
- A change in the pattern of trade that has no sufficient justification or objective economic reason other than the imposition of the measures.
- Manipulation of customs data and documents regarding the value, origin or customs classification of the product.
- Absorption of the measure by any means by the exporter, the importer or both.
It comes after Article 12 on complaints and investigation periods. Anyone whose business is accused of circumvention may consult a lawyer specialized in international matters and foreign investment.
Practical example
Anti-dumping duties were imposed on a product from a certain country, so the exporter began shipping it through a third country not subject to the measure, and the pattern of trade changed for no economic reason other than avoiding the duties. If this is proven and it is shown that dumping and injury continue, the Authority may widen the scope of the measures to cover imports coming from the third country.
