Article 4 explained in plain English
This article contains three provisions:
1) Scope of application: the Law applies to timesharing contracts concluded in the Kingdom, and also to contracts concluded outside it if the timesharing property is located inside the Kingdom.
2) Conditions of the contract the seller prepares:
- It must be in writing.
- It must include the details set in the Implementing Regulations.
- The contract and the document referred to in paragraph (1) of Article 3 must be drafted in Arabic, and they may be translated into other languages, provided that the Arabic version of the contract is the authoritative one.
The document meant is the document of complete and accurate information about the property that the seller is obliged to provide under Article 3, and it is considered an integral part of the contract.
3) A special prohibition for Makkah and Madinah: non-Saudis are prohibited, in accordance with the provisions of the Law, from:
- Carrying on the timesharing activity or marketing it in the two cities.
- Acquiring any right under timesharing contracts over tourist real estate units in them other than by inheritance, and any disposition made otherwise is not recognized.
Paragraph (3) was added by Royal Decree No. M/75 dated 2/12/1435 AH. Related to this is what Article 5 provides, that the buyer's right passes to his heirs after his death. Anyone with a contract concluded outside the Kingdom over a property in it, or who wants to check its status, should consult a lawyer specialized in real estate matters.
Practical example
A non-Saudi resident in Riyadh was offered the purchase of an annual right of use of a hotel apartment in Makkah under a timesharing contract. This disposition is prohibited to him by paragraph (3) and is not recognized, but if this right passed to him by inheritance, the prohibition does not cover him.
