Article 18 explained in plain English
This article begins the path for dealing with violations, and divides it into two stages:
Stage one: detection
- Monitoring committees are formed during the Hajj season and the Umrah season.
- They are made up of the Ministry, the Ministry of Interior and the Oversight and Anti-Corruption Authority.
- They catch violations of the provisions of the Regulation, draw up reports of them, and refer them to the Ministry to complete the necessary investigation procedures.
Stage two: considering the results
- The Ministry refers the results of the investigation to the committee referred to in Article 21 for consideration.
The monitoring committees do not impose penalties themselves; they catch violations and draw up reports, the Ministry completes the investigation, and the penalty is decided by the standing committee, whose formation and powers Article 21 sets out, in accordance with the penalties in Article 20. The Regulation thus separates the body that detects, the body that investigates and the body that imposes the penalty.
Anyone against whom a violation report is drawn up may consult a lawyer specializing in recruitment and visa regulations to understand their position.
