Article 13 explained in plain English
This article deals with two matters:
First: notice of non-extension or non-renewal. The leasing government body must notify the lessor and the Authority of its wish not to extend or not to renew the contract, through the portal or by any other means, as the Regulations specify. The article does not state a period for this notice, which is found in the Regulations.
Second: early rescission or termination. The body may rescind or terminate the contract and vacate the real estate before the end of its term as the Regulations specify, and the cases include:
- If the real estate is unfit for use because of a defect in construction.
- If the area surrounding the real estate is dangerous to the safety of those who visit it.
- Abolition of the leasing government body.
- Force majeure or emergency circumstances.
- Proof that the leasing process was not conducted with integrity for a reason attributable to the lessor.
- Any other case the Council specifies.
The phrase "the cases include" together with the last item means the list can be added to by the Authority's board of directors. The right established here belongs to the leasing body, and the article does not deal with the lessor's right to rescind.
Article 14 completes the picture by specifying what the body is not responsible for compensating when vacating, such as damage resulting from a construction defect or from ordinary use. Article 12 deals with the body remaining in the real estate after the term ends.
If you have a practical matter relating to leasing real estate to a government body, it would be best to consult a lawyer specializing in real estate cases or administrative cases.
Practical example
A government body leased a building in Najran for five years, and after two years a construction defect appeared in the building that made it unfit for use. Under this article, the body may rescind the contract and vacate the building before the end of its term, as the Regulations specify.
