Article 18 explained in plain English
After a pension application is accepted, beneficiaries are not all treated alike. This article requires the Ministry to classify each beneficiary into one of three categories:
- A beneficiary who cannot be rehabilitated.
- A beneficiary who can be rehabilitated: under Article 1, one who can be rehabilitated according to the rehabilitation plan.
- A beneficiary able to work: under Article 1, one who has the physical and mental ability to work.
The classification is based on the data and information relating to the beneficiary's health, physical, and social situation. The article refers to the Implementing Regulations to specify the rules on that, so the text itself does not set the detailed criteria for each category.
The importance of this classification is that it determines what is asked of the beneficiary. Article 17 makes it a case for stopping payment that a beneficiary who can be rehabilitated has not complied with his rehabilitation plan, or that a beneficiary able to work is not looking for work or has not accepted suitable work and training offers. These two cases do not concern a beneficiary who cannot be rehabilitated.
After classification, the Ministry, in cooperation with the Human Resources Development Fund and the relevant bodies, prepares rehabilitation plans and provides job search and follow-up services, as Article 19 provides. This achieves the Law's objective of enabling the beneficiary to reach financial independence.
Practical example
Saad's social security application was accepted. He is a healthy 28-year-old, so the Ministry classified him as "able to work". His elderly neighbor with a chronic illness may be classified as "not able to be rehabilitated" according to his health, physical, and social data and under the Regulations' rules.
