Article 4 explained in plain English
This article is the core of the Law's operating obligations, and it has four paragraphs:
- Installation and operation: those subject to the Law must install the camera system devices, maintain them and run them around the clock.
- Keeping recordings: recordings must be kept for the period stated in the conditions document (the article itself does not set this period). If there is a report of a particular incident, the recording must stay saved without any modification until the investigation procedures end, and it must be handed over to the Ministry or the Presidency of State Security, as the case may be, when requested.
- Classification by sensitivity: the Ministry classifies those subject to the Law into three categories:
- High sensitivity: their systems are linked directly to the operations rooms through secure networks under the conditions document, according to the security need.
- Medium sensitivity: linked directly to the operations rooms through open communication networks under the conditions document, according to the security need.
- Low sensitivity: no link to the operations rooms is required.
- Exemption from linking: government security and military bodies, the Ministry of Foreign Affairs and residential buildings, including residential complexes and apartment buildings, are exempt from the link to the operations rooms mentioned in paragraph 3. The exemption here is from the link only, not from the other obligations.
The article is connected to Article 3, which requires the camera installation requirements to be met before licensing or renewal, and to Article 5, which prevents carrying on the activity of manufacturing, importing, selling, installing, operating or maintaining cameras except after obtaining the necessary approvals from the Ministry.
