Article 2 explained in plain English
This article sets out the scope of application of the Law, that is, who is bound by its provisions. It lists 23 categories, the most notable being:
- Ministries, authorities and public institutions, oil and petrochemical facilities, and power generation and water desalination plants.
- Tourist accommodation facilities, commercial complexes and shopping centers, and financial institutions, banks, exchange and money transfer centers.
- Residential buildings, including residential complexes and apartment buildings, but under the conditions document, what the regulations set and the Law's provisions.
- The Grand Mosque, the Prophet's Mosque and the holy sites, and mosques and congregational mosques.
- Sports clubs, stadiums and facilities, cultural facilities and youth centers, entertainment facilities, and health facilities including medical cities, hospitals and clinics.
- Commercial warehouses, main roads and their intersections inside cities, and highways between cities and governorates.
- Fuel stations and gas sale outlets, educational facilities, facilities that provide food services, and public transport.
- Venues for events and festivals, places of economic and commercial activity, and museums and historical and heritage sites prepared to receive visitors.
The list is not closed: item 23 allows the Ministry to add any site, activity or facility it sees fit to add.
The article does not say where cameras are placed inside these facilities; it refers this to the regulations, together with the controls for maintaining the devices, provided that individuals' privacy and the Law's provisions are respected.
The article is connected to Article 1, which excludes from the definition of cameras those that individuals place inside their private housing units and complexes, and to Article 3, which prevents the competent government body from licensing those subject to the Law, or renewing their licenses, before the camera installation requirements in the conditions document are met.
To find out whether your activity falls into one of these categories, you may consult a lawyer specialized in administrative matters.
Practical example
Khalid owns a restaurant in Jeddah and asks whether the Law covers him. Item 18 of the article mentions facilities that provide food services, so his restaurant is within the scope of the Law, and he must comply with what the conditions document and the regulations provide on cameras and where they are placed.
