Article 1 explained in plain English
This is the definitions article. It fixes the meaning of the terms wherever they appear in the Law. The main ones are:
- The Authority: the Disability Care Authority. The relevant body: the body concerned with one or more of the fields covered by the Law.
- Person with a disability: any person who has a long-term disorder or impairment in physical, mental, intellectual, sensory or psychological functions which, when dealing with various challenges, may prevent the person from participating fully and effectively in society on an equal basis with others.
- Services: the integrated services provided to a person by virtue of health condition and degree of disability or social situation, including health, educational, training, rehabilitation, cultural, social, media and sports services, employment and others.
- Rehabilitation: the use of medical, social, psychological, educational, vocational and environmental services to help the person achieve the greatest possible effectiveness and self-reliance.
- Supporting educational and training services: the additional services that the nature of the disability requires in educational and training settings.
- Accessibility: appropriate measures that ensure persons with disabilities can reach services, the physical environment, transport, information, communications and facilities open to the public.
- Reasonable accommodation: measures that meet the special requirements of a person or group, ensuring they enjoy the basic rights and services, provided they do not impose a disproportionate burden on the body providing them.
- Discrimination on the basis of disability: any discrimination, exclusion or restriction because of disability whose purpose or effect is to impair or not recognize the person's rights.
An important difference: accessibility consists of measures ensuring that persons with disabilities can reach services and the environment on an equal basis with others, whereas reasonable accommodation is a response to the special requirements of a person or group. Article 2 builds on these definitions when it makes non-discrimination, accessibility and reasonable accommodation basic principles of the Law.
