Article 8 explained in plain English
This Article regulates the mortgagee's right to request division when the mortgage is on a commonly owned property, and distinguishes between two stages:
- Before the mortgagee's right of collection from the mortgaged property is established: he may not request division, except with the mortgagor's consent. As long as the debt has not reached the stage of collection, the decision on division remains with the mortgagor.
- After the right of collection is established: the mortgagee has two options: to request a sale of the mortgaged share in its undivided state, or to request division even without the mortgagor's consent.
In this way the Article balances two interests: the mortgagor's interest in not having the division of his property forced on him prematurely, and the mortgagee's interest in being able to collect his debt once his right to it is established.
This Article is linked to the seventh Article, which explains that a mortgage of an undivided share converts after division to the separated part in the mortgagor's share or to an amount equivalent to its value. The Article itself does not set the procedures for sale or division, and anyone facing a request for division or sale would do well to consult a lawyer specialized in real estate and real estate finance matters.
Practical example
Majed mortgaged his undivided share in a rest house in Riyadh to a creditor. The creditor wanted the rest house divided before the debt fell due and could not without Majed's consent. After the creditor's right of collection was established, he may request a sale of the share as it is, undivided, or request division even if Majed does not agree.
