Article 10 explained in plain English
This article answers two practical questions when the reconciliation with the victim's heirs is for a payment:
Who pays? The convicted person is the one required to pay.
How is the sum collected? If the convicted person, one of his relatives or his agent submits to the committee a request to open a bank account to collect the payment:
- The request is submitted to the Ministry of Interior for its approval.
- If the account is opened, it is under the supervision of the committee secretary.
It is therefore not enough under this article for the family to open an account themselves to collect the sum; the request goes through the committee and needs the Ministry of Interior's approval. This is consistent with paragraph 2 (f) of Article 6, which makes it one of the committee secretary's duties to supervise the bank accounts for collecting reconciliation sums and keep them confidential.
This comes after the reconciliation and its payment are recorded under Article 9. Anyone who wants to know the appropriate procedures for his situation may consult a lawyer specializing in criminal cases.
Practical example
The victim's heirs agree to forgive a convicted person in return for a sum of money, and his brother submits a request to the committee to open a bank account to collect the sum. The committee submits the request to the Ministry of Interior, and after approval the account is opened and is under the supervision of the committee secretary.
