Article 13 explained in plain English
This article aims to explain the tax to the public and help people comply. It contains three provisions:
- Guides and bulletins: the Authority issues the guides and tax bulletins needed to help the parties to real estate transactions meet their duties and strengthen their voluntary compliance.
- The clarifying decision: the Authority may issue a clarifying decision explaining the tax treatment of any transaction under the Law and the Implementing Regulations. It does so either on a request submitted to it, or on its own initiative when it sees a need. The Authority may publish the decision to the public on its website. The decision is issued in accordance with the provisions and procedures set by the Implementing Regulations.
- Adherence to the Law: the Authority must comply with the Law and the Implementing Regulations when it issues or amends these guides, bulletins and decisions, so it may not depart from them.
The practical benefit is that someone whose real estate transaction has an unclear tax treatment, for example because they are unsure whether it is subject to the tax or how it is calculated, can ask the Authority for a clarifying decision. The text does not state the conditions for a request, the response time or how far the decision is binding; these are found in the Implementing Regulations.
This article follows Article 12, which refers to the Implementing Regulations the controls, procedures and forms needed to implement the Law, and precedes Article 14, which defines what counts as tax evasion. Guidance and clarification come before accountability. To prepare a request for a clarifying decision on a complex transaction, you can consult a lawyer specialized in real estate and tax matters.
Practical example
A company in Riyadh wants to transfer a property to an investment fund under an unusual arrangement and does not know its tax treatment. It can submit a request to the Authority for a clarifying decision explaining the tax treatment of this transaction under the Law and the Implementing Regulations, and the Authority may publish the decision on its website.
