Article 12 explained in plain English
This is an organizational article. It does not itself impose a detailed obligation. Instead, it sets out what the Implementing Regulations must contain by way of controls, procedures, forms and documents for applying the Law. This is without prejudice to the powers of other bodies and to the provisions of the Law and of other related laws.
According to the article, the Implementing Regulations deal with matters such as:
- The controls and procedures for registering the real estate transaction with the Authority.
- The controls and procedures for correcting the data of a transaction registered with the Authority.
- The controls and procedures for examining the transaction and estimating its value.
- The procedures for notifying decisions issued by the Authority concerning the application of the Law and the Implementing Regulations.
- The forms, notices and electronic means needed to apply any obligation or procedure.
- The documents and records that must be kept for tax purposes, together with the retention periods, the means used and the controls for retention.
The word "including" means this list gives examples only, so the Implementing Regulations may address other matters needed for implementation. The text does not set retention periods or procedural details; these are found in the Implementing Regulations.
This article is linked to Article 11, on the confidentiality of information that reaches the Authority, and to Article 13, which requires the Authority to issue guides and tax bulletins to help the parties to transactions meet their duties and allows it to issue clarifying decisions. Anyone who needs to know a particular procedure, such as correcting the data of a registered transaction, should consult the Implementing Regulations or a lawyer specialized in real estate and tax matters.
