Article 13 explained in plain English
This Article regulates the stage of surveying the contents of the property, that is, documenting the buildings, plantings and other immovable things on the property, because it is the basis on which compensation is built.
- Entry and survey: carried out by the project owner or the supervising body with the participation of the owners or their representatives or the occupants of the property. If the body is a company or association, a representative of it takes part.
- If the owner refuses or cannot take part for any reason: a committee is formed, chaired by the body and including the relevant Emirate and the Ministry of Interior, to complete the task.
- The report: it includes the type of the property, its description, its contents and everything that may affect compensation, with drawings and photographs where needed, and attached to it a statement of the names of the owners and the deeds and documents.
- Signature: the body's representatives, the owners and the committee members, if any, sign it. If an owner refuses to sign or not all owners can sign, this is recorded with the reason, and objections are recorded, if any.
- Assistance from bodies: the body may seek the help of the related bodies and verify that the ownership documents or in rem rights satisfy the Sharia and statutory procedures.
- The deadline: a comprehensive report is referred to the Authority within a period not exceeding 60 days from the publication of the decision to begin in the Official Gazette.
The Article refers many details to the Regulations, including the time frames for notifying the survey date and taking into account the types of properties and cases of their occupation by persons other than their owners.
The owner's presence is important so that he can make sure everything on his property is surveyed, and he may record his objection in the report. Anyone with a dispute over the survey may consult a lawyer specializing in real estate cases.
Practical example
A family owns a farm in Al-Ahsa with a well, palm trees and a warehouse, and a transmission line project covers it. The eldest son attended on the day of the survey on behalf of the family and noticed that the report did not mention the well, so he asked for his objection to be recorded in the report before signing, which the Article allows.
