Article 22 explained in plain English
Article 22 sets the procedures for objecting to inspection reports, which go through three stages:
1) Notification: the Inspection and Follow-up Department notifies the Authority's member of:
- the report and the rating of his competence.
- everything placed in his file.
2) Objection: the member may submit his objection to the Inspection and Follow-up Department within thirty days of the date he is notified, unless he has an acceptable excuse for being late beyond this period.
3) Referral and decision:
- The Department refers the objection to the Authority's council, accompanied by a memorandum with its opinion on it, within fifteen days of the date it was submitted.
- The council decides the objection after reviewing the papers.
- The objector is notified of the council's decision in writing.
- The council's decision in this matter is final.
The right of objection covers the rating of competence, which is one of the grades in Article 21 (distinguished, above average, average, below average), as well as what is placed in the file.
It is followed by Article 23, which gives the Authority's council the power to set the duties of members and to issue the rules and procedures for inspecting and evaluating performance.
Because the objection period is fixed, an objecting member would do well to submit his objection promptly, and may consult a lawyer specializing in administrative cases (the Board of Grievances).
Practical example
An investigator in Dammam was notified of an inspection report that rated his competence "average", though he believes he deserves higher. He submitted his objection to the Inspection Department twenty days after being notified, the Department referred it to the Authority's council with a memorandum of opinion within fifteen days, and the council decided it and he was notified of its decision in writing.
