Article 1 explained in plain English
Article 1 sets the basic conditions that must be met by anyone appointed a member of the Authority, eight conditions together:
- He must be of Saudi nationality.
- He must be of good conduct and behavior.
- He must have the necessary capacity.
- Qualification: a certificate from a college of Sharia or an equivalent certificate, or a specialization in law from a university in the Kingdom or an equivalent certificate. In the case of an equivalent certificate, passing a special examination held for this purpose is required.
- His age must be no less than 22 years.
- He must be medically fit.
- He must not have been sentenced to a hadd penalty or a ta'zir penalty or for a crime involving moral turpitude or breach of trust, or been the subject of a disciplinary decision of dismissal from a public post, even if rehabilitated.
- He must successfully pass the test held for appointment.
One of the most important points in this Article is that rehabilitation does not remove the effect of the sentence or dismissal decision on the appointment condition; the text is explicit on this. A holder of an equivalent certificate also needs to pass a special examination in addition to the appointment test.
After appointment, Article 2 provides that members of the Authority undergo an intensive training program of not less than six months. Anyone whose appointment was refused and who believes he meets the conditions may consider consulting a lawyer specializing in administrative cases (the Board of Grievances).
Practical example
Sultan graduated from a law college at a university in the Kingdom and is 23 years old; he is Saudi, of good conduct and medically fit. He may apply for appointment as a member of the Authority once he passes the test held for appointment, provided the other conditions are met.
