Article 6 explained in plain English
This article sets the standard of a safe product, an important standard because Article 5 prohibits manufacturing, importing, marketing, circulating or advertising unsafe products.
Paragraph 1 - the general rule: a product is safe if the following come together in it:
- Its use under normal conditions of use presents no hazard, or may give rise to acceptable risks consistent with the specified safety levels that ensure the safety of the consumer, property and the environment.
- It meets all the essential requirements.
- It is in compliance with the technical regulations.
Paragraph 2 - where there are no requirements or regulations: if there are no relevant essential requirements or technical regulations, the product is safe if it conforms to the Saudi standards where available, or to the relevant regional or international standards.
Note that the text does not require the complete absence of hazard, but accepts acceptable risks consistent with the safety levels. The standard is also tied to "normal conditions of use".
Article 7 follows, setting what is taken into account when assessing a product's safety, such as its properties, instructions for use, manner of presentation, the consumer who may be exposed to the hazard and the consumer's legitimate expectations.
Practical example
A company in Dammam makes household heaters. If a technical regulation applies to heaters, the product is not safe unless it meets the essential requirements and complies with that regulation, in addition to presenting no hazard or having acceptable risks in normal use.
