Article 7 explained in plain English
This article shows the elements that must be taken into account when assessing whether a product on the markets is safe, and there are five:
- The product's properties, including its composition, and its instructions for use, installation and repair.
- The effect of the product on other products if used with them.
- The manner in which the product is presented, its information, its instructions and warnings for use, its disposal instructions, and other information relating to it.
- The consumer who may be exposed to a hazard when using the product.
- The consumer's legitimate expectations relating to safety.
It is clear from this that a product's safety is not measured by the product alone, but by the information and warnings accompanying it and by those expected to use it. The same product may be acceptable for one group of consumers and present a hazard for another, and a lack of warnings or unclear instructions can affect the assessment of its safety.
The article complements Article 6, which sets the standard of a safe product: that it presents no hazard or its risks are acceptable in normal conditions of use, with the essential requirements met and compliance with the technical regulations. Article 8 follows, providing that the possibility of achieving higher levels of safety or of obtaining another, less hazardous product is not by itself sufficient for considering a product unsafe.
Practical example
A company in Riyadh sells a strong household cleaner, but it is presented in a container that looks like juice containers and without clear warnings. When assessing its safety, the manner of its presentation, its warnings and the consumer who may be exposed to the hazard, such as children in the home, are taken into account.
