Article 3 explained in plain English
This article regulates two related matters concerning how guard service is obtained and managed:
First: direct contracting with guards
Two categories may contract directly with security guards, without going through a guard company:
- Entities required to place private civil security guards, which are those specified by the Regulations under Article 2.
- Anyone requesting guard service who is not required to have it, whether an individual, a group or a facility.
The contract must be with Saudi individuals licensed to work as security guards. This is consistent with Article 1, under which guard service may be obtained by direct contracting with licensed guards.
Second: the security department
Required entities must set up a security department if the number of guards assigned to them is more than 20 guards. An entity with exactly 20 guards is not bound to do so under the text of the article, whereas one with 21 or more is. The Regulations specify the tasks and duties of this department.
Note that the text limits the obligation to set up a security department to required entities and says nothing about those who are not required. Likewise, the permissibility of direct contracting for those who are not required does not replace the permission that Article 2 requires.
If you have a specific case, it is best to consult a lawyer who specializes in administrative matters and security licensing laws.
Practical example
An industrial company in Jubail, which is one of the entities required to have guards, contracted directly with 25 licensed Saudi guards. Because its guards number more than 20, it must set up a security department to carry out the tasks and duties specified by the Regulations.
