Article 13 explained in plain English
This article regulates oversight of private laboratories. Monitoring laboratories, inspecting them and recording violations of the provisions of the Law and of the regulations and decisions issued to implement it are carried out by specialized employees.
The article refers three matters to the Implementing Regulations:
- The body or bodies responsible for naming these employees.
- The powers of the employees authorized to enter laboratories and inspect them, record violations, retain the samples, documents and devices subject of the violation, conduct the necessary investigations, and the grounds for seeking help from the security authorities.
- The body that has the right to authorize entering laboratories for inspection purposes.
In return, the article places obligations on the inspectors themselves:
- To observe confidentiality and good conduct.
- To show the interested party proof of their identity, official capacity and the purpose of the visit.
Violations recorded by these employees may result in the delay fines in Article 12, and other penalties in the Law. The procedures for investigation and prosecution are set by the Regulations under Article 14. A person whose laboratory is subject to inspection or recording of a violation can consult a lawyer specializing in administrative cases.
Practical example
