Article 12 explained in plain English
This article deals with two cases of delay, each with its own fine:
- Delay in renewing the licence: a fine of SAR 1,000 for each year of delay, and renewal is from the date the licence ends, so the late party gains nothing from his delay in calculating the new licence period.
- The laboratory's delay in giving the result: a fine equal to the costs of the test subject of the violation, if the laboratory is late in giving the result within the period specified in paragraph (4) of Article 10.
The period specified in paragraph (4) of Article 10 is that the laboratory returns the results with the remaining samples, or what shows they were consumed, to the body they came from within 15 days of the date the sample was drawn, and the competent Ministry is to be notified of the test result within a period not exceeding 25 days of the date the samples were drawn.
These fines differ from the general penalties in Article 11 (a warning, a fine of SAR 5,000 to 20,000, suspension of the licence, and its withdrawal in case of repetition), as they are specific to the cases of delay mentioned.
Practical example
The licence of a laboratory in Makkah expires, and its owner does not apply to renew until two years after it ended. A fine of SAR 1,000 for each year of delay applies, that is, SAR 2,000, and renewal is counted from the date the licence ended.
