Article 21 explained in plain English
This article is short but establishes an important guarantee: an administrative procedure may not delay the release of a prisoner or detainee at the set time.
In practical terms this means:
- If the set time for the release of a prisoner or detainee arrives, he may not stay in custody because of administrative procedures that are not complete, such as finishing paperwork or waiting for signatures.
- The article covers both the prisoner (the convict) and the detainee.
- What counts is the set time for release, so administrative procedures must be completed in a way that does not exceed it.
The article itself does not explain how this time is determined, or what follows from violating this provision; the text is limited to preventing delay.
The article comes between two provisions: Article (20), which sets the penalties that may be imposed on a prisoner or detainee who violates order, including solitary confinement and loss of privileges, and Article (22), which refers to the Implementing Regulations the rules on social and health care and health-related release.
If the release of a relative of yours is delayed after its date has arrived, it is appropriate to consult a lawyer who specializes in criminal cases to learn the steps available.
Practical example
The set date for the release of Nasser from a prison in Abha arrived, but the administration told him that some paperwork was not yet complete. Under this article, this administrative procedure may not delay his release beyond the set time.
