Article 41 explained in plain English
This article protects the secrets of inventors who file protection applications, by imposing two obligations on Administration employees and Committee members.
First obligation: confidentiality
- Not to disclose to any person the technical information relating to protection applications that they obtained by virtue of their position, unless that person is officially authorized to receive it under the rules in force in the Kingdom.
- Not to disclose that information to the public, and not to use it in any way.
- This obligation continues after their service ends, with no time limit in the text.
Second obligation: no dealing
- They may not obtain any protection document, or deal in any right relating to one.
- This bar applies during service and for two years after it ends.
The difference between the two periods is clear: confidentiality continues with no set end, while the bar on acquiring and dealing ends two years after leaving service.
This contrasts with Article 40, which allows inspection of registered protection documents: publicity concerns registered documents, whereas the confidentiality here concerns the technical information in protection applications that these persons obtained through their work.
Anyone who suspects that information in their application has leaked would do well to consult a lawyer specializing in intellectual property and patents.
Practical example
Saad worked as an employee in the Administration and saw a patent application for an invention in the energy field, and then left his job. Saad may not disclose or use the technical information in that application even after leaving, and for two years after his service ends he may not obtain any protection document or deal in any right relating to one.
