Article 29 explained in plain English
This article explains a number of places connected with aggravation in drug and psychotropic substance offenses, and sets out the scope of each:
- The mosque: its service facilities are treated as part of it, so it is not limited to the prayer area.
- The Two Holy Mosques: their sanctity and holiness are taken into account in applying aggravation.
- Places of education and training: aggravation covers all places set aside for education or training, the activities connected with them, their affiliated facilities, and the places adjacent to them.
- Correctional institutions: these include detention centers, reformatories and prisons, and guidance and observation centers and social care institutions for girls.
In practical terms, this article does not create the punishment or fix the amount of the aggravation. It sets out the boundaries of the places that are considered when applying the aggravation provided for in the Law. Committing the offense in a service facility belonging to a mosque, in a place adjacent to a school, or in a detention center falls within this scope, according to the wording of the article.
The available text does not show the article of the Law that provides for the aggravation or its amount. Anyone facing a charge connected with these places is well advised to consult a lawyer who specializes in criminal cases.
Practical example
A person was caught selling a narcotic substance at the gate of a secondary school in Riyadh. Under the article, aggravation covers places adjacent to places of education, not just the school building itself.
