Article 31 explained in plain English
This article sets the limits of the Military Retirement Fund's obligations, and divides the burden between the Fund and the Ministry of Finance:
- What the Fund is bound by: pensions and retirement contributions that fell due under the provisions of:
- this law, and
- the Military Retirement Law of 1380 AH.
- What the Ministry of Finance bears: pensions and compensation that fell due under laws earlier than these two laws.
The Fund is therefore not loaded with obligations that arose under earlier laws, and those obligations remain with the Ministry of Finance. A pensioner whose entitlement arose under an old law does not lose his right; only the body that bears it differs.
This article follows Article 30 on handling a deficit or surplus in the Fund: a deficit is settled in the way the board of directors sets and the Council of Ministers approves, and a surplus that allows new benefits is decided on the board's recommendation and with the Council of Ministers' approval. The two articles together draw the Fund's financial framework.
The Fund, as defined in Article 2, is the Military Retirement Fund. The article does not explain how the pensions borne by the Ministry of Finance are paid or the procedures for it. It is followed by Article 32, which allows a person referred to retirement to be kept on for a period not exceeding two months to hand over what is in his custody.
