Article 26 explained in plain English
This article deals with the case of a retired military member who returns to service in a post subject to the provisions of the Military Retirement Law. It contains three provisions:
- Suspension of the pension: payment of his retirement pension is suspended for the whole period of his return to service.
- Adding periods together: his later period of service is added to his earlier service when he is retired again.
- Basis of settlement: his retirement salary is settled on the basis of his last salary.
A person who returns to service therefore does not combine the pension with the salary of a post subject to this law, but he does not lose his earlier service: the new service is added to it, and his new pension is calculated on the last salary he receives.
Note that the article concerns return to a post subject to the provisions of this law, that is, a military post to which the Military Retirement Law applies.
Article 27 brings a closely related provision for another case: a military member who is returned to service and had received compensation, an award or contributions for earlier service. That period may be counted for him on condition that he requests it within one year at most from the date of his return, and refunds what he received. The difference is that Article 26 concerns a pensioner, while Article 27 concerns someone who received compensation, an award or contributions.
Someone considering returning to military service after retirement who wants to know the effect on his pension may contact the General Retirement Organization or consult a lawyer who specializes in administrative cases.
Practical example
Major Bandar retires after 20 years and a pension is set for him. He is then returned to service in a post subject to the Military Retirement Law for 4 years. Under this article, payment of his pension is suspended throughout this period, and when he is retired again the four years are added to his earlier service and his pension is settled on his last salary.
