Article 9 explained in plain English
This is one of the most important Articles of the Law, as it sets out the rights of the mental patient, which his guardian or agent claims on his behalf. The main ones:
- Treatment and dignity: care in a safe and clean environment, treatment according to medically recognized standards, taking part in the treatment plan if he is able, and being enabled to perform his religious duties. He may not be admitted to any facility except under the provisions of the Law.
- Prior knowledge: being told the diagnosis and the treatment plan with its benefits, risks and alternatives before treatment, and knowing the reasons for any transfer.
- Consent: he may not be given experimental treatment or enrolled in research except with written consent from him, from his guardian, or from the local council, as the case may be. No treatment of any kind is given without his consent or that of his guardian; if he is unable and has no guardian, or the guardian cannot be reached, the necessary treatment may be given with the approval of two psychiatrists and notice to the local council.
- Protection: from degrading treatment and financial, physical or sexual exploitation, and no physical or moral punishment or threat of either, whatever the reason.
- Liberty: he is isolated only when the treating physician decides it is needed, for a specified period and by the least restrictive means, with freedom of movement consistent with treatment and safety.
- Property, communication and visits according to treatment and safety requirements and what the Implementing Regulations set, with his relatives' contact with him guaranteed.
- Religious healing (ruqyah) after coordination with the treating physician, in accordance with the Quran and the Sunnah.
- Confidentiality: his information is not disclosed except at the request of the two supervisory councils or the judicial or investigation authorities with the purpose stated, for treatment purposes, or because of inevitable danger to himself or others.
- Complaint without his care being affected, and appointing a legal agent.
- Notification: telling him or his guardian in writing of compulsory admission, its reason and the ways to cancel it under paragraph (e) of Article 14, giving him a copy of his rights, and posting them in visible places.
Paragraph 16 refers to paragraph (e) of Article 14, which allows a grievance against a compulsory admission decision or its extension before the local council in writing, by contact, or through the guardian or agent.
If you have a specific case, it is best to consult a lawyer who specializes in health regulations and patients' rights.
Practical example
A woman was admitted to a mental health facility in Riyadh, and her family asked for a religious healer to perform ruqyah for her. She is entitled to that after coordination with the treating physician. The facility may not isolate her except when the physician decides it is needed and for a specified period, and she or her guardian must be given a copy of her rights.
