Article 7 explained in plain English
This Article details the powers of the local supervisory council formed under Article 6, which is the body closest to the patient's daily life:
- Oversight: supervising the application of the Law in facilities within its local jurisdiction, either itself or through committees that inspect the facilities and admitted patients, examine records and reports, and correct violations, with periodic reports every six months to the General Council.
- Hearing grievances of patients, their relatives or their representatives.
- Approving non-conventional treatment for a compulsorily admitted patient at the request of the treating physician, setting out the reasons and the results sought, where the patient is unable to consent or his guardian cannot be reached.
- Following up the facilities' reports on compulsory admission and treatment cases.
- Canceling a compulsory admission decision if reasons appear that the council assesses, and considering the case of those compulsorily admitted for more than six months.
- Assigning a psychiatry consultant from outside the facility to examine the patient when needed, within two weeks of the date of the grievance, so that the council can decide on it.
- Proposing someone to look after the interests of a compulsorily admitted patient who lacks legal capacity and has no guardian, until he regains capacity, and submitting that to the competent court for approval.
- Receiving facilities' notifications of compulsory admission cases and following them up, and making sure patients enjoy the safeguards and rights.
- Any task the General Council assigns it.
In practice, the local council is the first body a patient or his family turns to when objecting to compulsory admission. Its meeting schedule and the time it takes to answer grievances are regulated by Article 8.
If you have a specific case, it is best to consult a lawyer who specializes in health regulations and patients' rights.
Practical example
A woman in Dammam whose brother was compulsorily admitted believes his condition has improved. She files a grievance before the local supervisory council. The council may assign a psychiatry consultant from outside the facility to examine him within two weeks of the date of the grievance, and it may cancel the compulsory admission decision if reasons appear that it assesses.
