Article 17 explained in plain English
This Article regulates compulsory treatment care, meaning requiring the patient to receive treatment without admitting him to the facility, at outpatient clinics or at his place of residence.
- Conditions: the person must have a mental disorder and need treatment care, by a decision approved by two psychiatrists setting out the reasons and the treatment plan. It is imposed against the patient's will, with the local council notified within 48 working hours.
- Non-compliance: the facility may ask the local council to take the appropriate action. For care at the place of residence under the supervision of a psychiatry specialist, the patient or his guardian must follow the treatment team's instructions.
- Refusal: two psychiatrists reconsider his condition, and if the conditions of Article 13 apply they prepare and sign a detailed report so that he is admitted to the facility compulsorily, with the local council notified.
- Duration: not more than 180 days, extendable or renewable as needed.
- Objection: the patient, his guardian or his agent may object at any time before the local or the General council, as the case may be.
- Request to end: in writing, and the facility must respond within 7 days of receiving it; if it sees that care should continue, an objection may be made before the local council.
- Cases of ending: the decision of the treating psychiatrist with a report to the local council, the period ending without renewal or extension, or the opinion of the local council.
The Implementing Regulations set the procedures for a patient's request to transfer his treatment to another facility.
Note that the condition for this care is "a mental disorder", without the severity and danger required for compulsory admission in Article 13.
