Article 7 explained in plain English
This article sets out what the inspector does in the labor office:
- Monitoring: monitoring application of the Labor Law and the regulations and decisions issued under it in the establishments subject to inspection, by verifying through visits that the legal precautions and conditions are carried out, and taking the necessary action if they are not.
- Visits: visiting the workplaces under his supervision in accordance with the instructions, and explaining to the employer or his representative his task and the purpose of his visit with the kindness and tact needed to gain his confidence.
- Reports: on all his remarks and observations relating to application of the provisions.
- Assistance and guidance: assisting workers and employers and guiding them to the best ways to apply the Law, regulations and instructions.
- Studying working conditions and submitting reports to the Ministry, particularly on shortcomings that the laws have not addressed.
- A monthly report on inspection activity in the office's area, covering the establishments inspected, the number and type of violations, obstacles and proposals.
- An annual report on inspection activity, its results and its effects; the Ministry issues instructions on organizing the two reports and their forms.
The inspector's role is thus both supervisory and advisory. These tasks complement his powers in Article 11 and the measures he takes under Article 12. An employer or worker with a question about an inspection visit may consult a lawyer specializing in labor cases.
