Article 5 explained in plain English
After Article 4 defined the eligible family, this article sets out who submits the application on behalf of the family:
- The husband or father: the basic rule for applying for the family.
- The wife: she may also submit the application.
- A divorced mother: provided that a period set by the Implementing Regulations has passed since her divorce.
- A mother whose husband has died: she has the right to submit the application.
- Siblings referred to in paragraphs (5) and (6) of Article 4: they submit the application jointly, not individually.
The article left it to the Implementing Regulations to set the periods, controls and procedures needed for this, including the divorce period required of a divorced mother, so that period cannot be estimated without referring to the Implementing Regulations.
The article was amended by Council of Ministers Resolution No. (850) dated 29/11/1446 AH, and the text shown above is the text in force. Article 6 completes the picture, requiring the applicant to be of Saudi nationality and not under 25 years old, with the mother, the wife or siblings jointly excepted from the age condition.
Practical example
Hind is a divorced mother living with her two unmarried daughters in Jeddah. She may submit the housing support application for the family once the period set by the Implementing Regulations has passed since her divorce, and she need not be 25 because Article 6 excepts the mother from the age condition.
