Article 4 explained in plain English
This article specifies who counts as a family that can benefit from housing support, subject to the conditions of Article 5 (who submits the application) and Article 6 (conditions for the applicant). A family is one of the following groups:
- A husband and wife.
- A husband and wife with one or more of their children.
- A father with one or more of his children.
- A mother with one or more of her children.
- Two or more brothers and sisters if the parents have died.
- One or more brothers and sisters if the mother is not Saudi and the father has died, or the mother is the sole breadwinner for her Saudi children.
In every group that includes children or siblings, a male must be unmarried and no older than 25, and a female must be unmarried.
The article adds an important rule: anyone who, under the Regulation, has the right to apply for housing support for an independent family is not counted as a member of the family, such as a married son who forms a family with his wife. The article also left it to the Implementing Regulations to specify who is treated as part of the family among those not covered by these groups, a wording added by Council of Ministers Resolution No. (74) dated 30/1/1438 AH.
Anyone who doubts that the description of a family applies to their situation can refer to the Implementing Regulations or consult a lawyer who specializes in real estate and administrative cases.
Practical example
Sarah's father and mother have died, and she lives with her brother Khalid (22, unmarried). Under paragraph (5) the two count as a family for housing support, whereas their older married brother is not counted with them because he has the right to apply for his own independent family.
