Article 28 explained in plain English
This article sets the most severe penalties in the Law, which are: imprisonment for a period not exceeding six months, and a fine not exceeding SAR 100,000, or either of these penalties. This penalty applies without prejudice to any more severe penalty provided for in other laws.
The penalty covers anyone who:
- Practiced the healthcare professions without a license.
- Gave inaccurate information or used unlawful methods that resulted in their being granted a license.
- Used a means of publicity that leads the public to believe, contrary to the truth, that they are entitled to practice the healthcare professions.
- Falsely assumed a title usually given to those who practice the healthcare professions.
- Was found in possession of machines or equipment usually used in practicing the healthcare professions, without being licensed to practice them or without a legitimate reason for possessing them.
- Refused to treat a patient without an acceptable reason.
- Violated specific provisions of the Law: paragraph (b) of Article 7, which prohibits unrecognized or prohibited diagnosis and treatment methods in the Kingdom, Articles 9, 11, 19, 20, 22, 23 and 24, paragraphs (a) and (f) of Article 14, and paragraph 3 of Article 27 on performing experimental and unprecedented surgical operations on humans in violation of the rules regulating them.
- Trafficked in human organs, or performed a human organ transplant knowing that the organ was obtained through trafficking.
Note that the penalty also covers unlicensed persons, not healthcare practitioners alone. It is followed by Article 29, which punishes other violations with a fine not exceeding SAR 50,000. Anyone facing a charge under this article may consult a lawyer specialized in criminal matters and healthcare practice.
Practical example
A person in Riyadh with no healthcare license set up a room in his home where he offers physical therapy sessions and presents himself to people as a "physical therapy specialist". This act amounts to practicing the healthcare professions without a license and falsely assuming a title of those who practice them, exposing him to imprisonment of up to six months and a fine of up to SAR 100,000, or either.
