Article 30 explained in plain English
This article is the Law's general fallback penalty. It applies to any violation:
- of the provisions of the Law itself, or
- of the provisions of its Implementing Regulations,
provided the Law has not provided a specific penalty for it. The penalty is a fine not exceeding SAR 20,000.
To understand its place in the Law, compare it with the preceding Article 29, which punishes with a fine not exceeding SAR 50,000 the violation of Articles 10, 12 and 13 and paragraphs (b), (c), (d) and (e) of Article 14. Those are violations to which the Law gave a specific penalty, while this article covers everything else for which no specific provision exists.
So if someone violates a provision of the Law that has no specific penalty in it, this article is the one that applies. Note that it covers violation of the Implementing Regulations too, not just the Law.
It is followed by Article 31, which makes the healthcare practitioner subject to disciplinary accountability if they breach their duties or violate the principles of their profession, without prejudice to criminal or civil liability. Anyone on whom a fine has been imposed and who wishes to know their options may consult a lawyer specialized in healthcare practice and medical malpractice cases.
Practical example
A healthcare practitioner in Tabuk violated a provision of the Law's Implementing Regulations for which the Law has no specific penalty. In this case this article applies, and he is punished with a fine not exceeding SAR 20,000.
