Article 14 explained in plain English
This article sets out a list of six prohibitions on the healthcare practitioner:
- (a) Employing unlicensed persons from the healthcare professions, or helping anyone who practices a healthcare profession unlawfully.
- (b) Keeping medicines and vaccines at the workplace contrary to what the Ministry's instructions allow; pharmacy facilities are excepted.
- (c) Selling medicines to patients except in pharmacy facilities, and selling medical samples absolutely, meaning without any exception.
- (d) Facilitating the patient's obtaining any advantage or benefit, material or moral, that is undeserved and unlawful.
- (e) Accommodating patients in places prepared for that (as the text words it), except as ambulance or emergency cases require.
- (f) Using examination or treatment devices prohibited in the Kingdom.
The list has a common idea: protecting the patient from unlicensed practice, from uncontrolled medicines and devices, and from mixing treatment with trade. A medical sample, for example, is never sold, and medicine is sold to patients only in pharmacy facilities.
The article follows Article 13, which prevents examination and treatment in pharmacies and non-designated places except in emergency cases, and precedes Article 15, which requires diagnosis to be carried out with the necessary care. Anyone who needs an assessment of their facility's position or a particular act may consult a lawyer specialized in healthcare practice and medical malpractice cases.
Practical example
A dentist owns a clinic in Riyadh and hired an assistant without a professional license to do fillings for patients, and he also sells patients free samples of a therapeutic toothpaste that he obtained from a company. Both acts are prohibited: the first under paragraph (a), and the second under paragraph (c), which prohibits selling medical samples absolutely.
