Article 61 explained in plain English
This article regulates the committee that decides value and the importer's right to appeal against an increase in the value of his goods. It was amended by Royal Decree No. (M/81) dated 4/6/1444 AH, and the explanation here is of the text in force.
Formation of the committee and its task:
- It is formed from the Administration's employees by decision of the Director General or whoever he authorizes.
- Its task is to resolve disputes between the customs department and the interested parties over the value of imported goods.
- It may seek the help of whoever it considers to have the expertise.
The appeal:
- The importer is entitled to appeal to the committee against decisions increasing the value of the goods.
- The deadline: 15 days from the date the customs declaration is registered, or from the date he is informed of the value the Administration assessed by registered letter with acknowledgment of receipt.
- This is without prejudice to the importer's right to go to court.
The committee's decisions: They are issued by majority and take effect after being ratified by the Director General or whoever he authorizes; the importer must be informed of them in writing, and they must be reasoned.
Article 62 shows how a dispute over value reaches this committee through the Director and then the Director General. Because the deadline is short, an importer whose goods' value has been increased would do well to consult a lawyer specializing in customs and commercial matters immediately.
Practical example
A car importer in Riyadh was surprised that Customs assessed his shipment's value higher than the invoice. He has 15 days from the registration of the declaration or from being informed of the assessed value to appeal to the value committee, and his right to go to court remains.
