Article 35 explained in plain English
This article is the Law's main penalties article, and it has four paragraphs:
1- Delay in payment: anyone proven to have delayed paying their debt is punished with a fine not exceeding twice the profit on the obligation subject to the delay for its period, and the penalty is repeated each time the delay is repeated. The fine is deposited in the account of the body supervising civil associations and is allocated to supporting public-benefit associations. What counts is that delay is proven, not mere lateness.
2- Violating the Law: anyone who violates any provision of the Law or its regulations is punished, according to the gravity of the violation, with a fine whose upper limit is SAR 2 million or 10% of the amount of financing the violator carries on, whichever is greater, and with imprisonment for up to two years, or with one of these two penalties, without prejudice to Article 34. The fine is remitted to the State General Treasury.
3- Precautionary attachment: the Saudi Central Bank has the power to impose a precautionary attachment on the funds of a person who has been caught and against whom there is strong evidence of violating paragraph (1) or (2) of Article 4, which prohibit carrying on finance activities without a license and prohibit using anything that indicates them or suggests their meaning by a person who is not licensed. The attachment may not exceed the upper limit of the fine or the percentage in paragraph (2), and it continues until the competent court examines and rules on the violation.
4- Publication: the judgment may include publication of a summary of it, at the violator's expense, in a local newspaper or another suitable medium.
Paragraph (2) was amended and paragraphs (3) and (4) were added by Royal Decree No. (M/24) dated 15/3/1443 AH.
It is preceded by Article 34 on the Authority's fines for violations of Article 29, and followed by Article 36, which gave entities working in finance before the Law took effect a two-year period to regularize their status.
Because the penalties may include imprisonment, anyone facing an accusation or claim under this article is advised to consult a lawyer specialized in banking and finance.
Practical example
Saad in Riyadh lent money to people in return for profit and advertised this without a license. After he is caught and there is strong evidence against him, the Central Bank may impose a precautionary attachment on his funds up to the upper limit of the fine until the competent court rules, and he may be punished with a fine, imprisonment or both, with a summary of the judgment published at his expense.
