Article 34 explained in plain English
This article gives the Minister, who is the Minister of Health, a precautionary power before any penalty is issued:
- The measure: a temporary suspension of the license to practice.
- Duration: until the violations committee provided for in Article 28 issues its decision.
- The cases: either of two:
- Being caught in the act of committing the violation.
- The existence of evidence and indications that point toward guilt.
- Nature of the power: discretionary ("the Minister may").
Protecting patients: if the suspension will harm the patients benefiting from treatment, the Minister must take what is needed so they continue to receive what they need. A suspension may not leave patients without care.
Grievance: a person against whom a suspension order is issued has the right to file a grievance with the Board of Grievances within 30 days of being notified.
Under Article 28, the violations committee is a committee chaired by a judge that considers violations of the Law and its Regulations, imposes penalties other than imprisonment and determines compensation, and refers anything warranting imprisonment to the Board of Grievances. Article 35 follows, allowing a grievance against the penalty decision itself before the Board of Grievances within 60 days. The grievance period for a temporary suspension (30 days) is thus shorter than for a penalty (60 days). A person whose license has been suspended should act promptly and consult a lawyer who specializes in administrative cases (the Board of Grievances).
Practical example
A physician at a private center in Jeddah is caught in the act of performing an operation that violates the Law. The Minister temporarily suspends the license until the violations committee issues its decision, and takes what is needed to transfer the patients who are following treatment with the physician to other physicians. The physician may file a grievance against the suspension with the Board of Grievances within 30 days of being notified.
