Article 32 explained in plain English
This article sets the most severe penalties in the Law, without prejudice to any more severe penalty in other regulations. One or more of the following may be imposed:
- A fine of not less than SAR 200,000 and not more than SAR 500,000.
- Imprisonment for a period not exceeding five years.
- Revocation of the license to practice the profession.
These apply to anyone who commits any of the following violations:
- Practicing infertility treatment and fertilization without a license or at a level other than the licensed level.
- Injecting sperm or embryos into a woman other than his wife.
- Injecting sperm or embryos after the marital relationship has ended.
- Transferring a woman's zygotes or embryos into the womb of another woman.
- Misleading the patient or not using sound medical principles in treatment with the intent of extortion or exploitation.
- Interfering with hereditary cells or genes without the prior approval of the Supervisory Committee.
- Transplanting reproductive organs.
Note that the fine here has a minimum that cannot be gone below, and that item 5 requires an intent of extortion or exploitation. Article 33 then punishes the other violations of the Law and its Regulations, apart from those in this article, with lighter penalties starting with a warning. Before it, Article 31 provides that a member of the Bureau of Investigation and Public Prosecution represents the prosecution before the violations committee. A person charged with one of these violations would be well advised to consult a lawyer who specializes in criminal cases and health regulations.
Practical example
A clinic in Riyadh is licensed for the lower level of infertility treatment but performed ICSI procedures without a license for that level. This is a violation under item 1 (practicing at a level other than the licensed level), and it may be punished by a fine of not less than SAR 200,000 and not more than SAR 500,000, or by the other penalties mentioned, or by more than one penalty.
