Article 1 explained in plain English
Article 1 names the body responsible for dealing with expatriate violators: the Ministry of Interior, represented by its security sectors. It divides the Ministry's tasks into two categories:
First: arresting the expatriate violators themselves, who are:
- Expatriates who work for themselves, which the text calls "free-floating labor".
- Those absent from work.
- Those who overstay among people who entered on Hajj, Umrah, visit (of all types), tourism, treatment or transit visas.
- Infiltrators arrested outside the border area.
The Ministry detains these persons, imposes penalties on them and deports them.
Second: arresting those who deal with them, who are:
- Anyone who employs any of the violators mentioned.
- Anyone who lets his workers work for themselves.
- Anyone who conceals, harbors or transports them, and anyone who provides them with any means of help.
- Sponsors of visitors who did not report that those they brought in had overstayed the set departure time.
So responsibility does not fall on the expatriate alone, but extends to the employer, the transporter, the person who shelters and the sponsor. Article 2 sets who bears the cost of deportation in each case. Anyone accused of employing or sheltering a violator would do well to consult a specialist lawyer in residency laws and administrative cases.
Practical example
A visitor came on a visit visa and overstayed after his period ended, then worked for a workshop in Riyadh, and an acquaintance drove him daily in his car. Under this article, the security authorities arrest the expatriate himself, as well as the workshop owner who employed him and the person who transported him.
