Article 171 explained in plain English
This article of the Implementing Regulations of the Criminal Procedure Law preserves the role of the Authority in supervising the carrying out of criminal judgments. Under the definition in Article 1 of the Regulations, the Authority is the Bureau of Investigation and Public Prosecution.
Content of the article: the provisions in this Part, which is Part Eight on enforceable judgments and the procedures and rules for carrying them out, do not prejudice the Authority's powers to supervise the carrying out of criminal judgments under the Law of the Bureau of Investigation and Public Prosecution.
"Do not prejudice" means that what the Part provides by way of procedures, such as the administrative governor determining who carries out the sentence, forming committees to witness execution, and drawing up execution records, is not to be understood as reducing the powers set for the Authority in its law.
This article does not set out those powers in detail; it refers to the Law of the Bureau of Investigation and Public Prosecution for them.
The Authority's role appears in several articles of this Part. Article 156 requires a member of the Authority and a specialist doctor to attend, in addition to the committee, when death, amputation, stoning, or retaliation sentences are carried out. Article 165 allows the member of the Authority supervising the execution to stop flogging if it appears to him unsuitable in severity or weakness. Article 168 makes the name of the supervising member of the Authority one of the details of the execution record and requires that he be supplied with a copy. Article 170 also provides for applying the relevant rules and instructions on execution where there is no specific provision.
Anyone with an observation about the carrying out of a judgment is advised to consult a lawyer who specializes in criminal cases.
