Article 168 explained in plain English
This article of the Implementing Regulations of the Criminal Procedure Law requires the carrying out of the sentence to be documented in a written record, and specifies its contents and what becomes of it.
Contents of the record:
- The number, date, and content of the judgment imposing the sentence.
- The number and date of the execution order.
- The name and personal details of the person subject to the sentence.
- The place, time, and date of execution.
- A statement showing that the judgment was carried out, in whole or in part.
- The names of the members of the committee that witnessed the execution, the member of the Authority supervising the execution and the specialist doctor if present, and the person who carried out the execution, with their signatures and any observations any of them has on the execution.
What becomes of the record: the head of the committee that witnessed the execution submits the original of the record to the administrative governor, and the committee members and the member of the Authority are supplied with copies of it.
Note that the record can show that the judgment was carried out in whole or in part, and that it includes the observations of those present if any, which is consistent with Article 165 of the Regulations, allowing a member with a different view on carrying out flogging to record it in detail in the execution record. Article 169 also provides that after execution the judgment instrument is sent to the court for the circuit that issued it to annotate it with the execution.
Anyone who needs proof that a judgment issued in their case was carried out is advised to consult a lawyer who specializes in criminal cases.
